Terms of Service

1. Who we are

Osyren ("the Service", "the App") is operated by:

References to "we", "us", or "our" in these Terms refer to KDN Estate SRL.

2. Agreement

By creating an account or using the Osyren mobile app or website (osyren.app), you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the service.

3. Who can use Osyren

Osyren is intended for users 17 years and older. Some features (notably AI image generation) may not be appropriate for minors. By using Osyren, you confirm:

• You are at least 17 years old.
• You have the legal capacity to enter into this agreement.
• If using Osyren on behalf of an organization, you have authority to bind that organization to these Terms.
• You will not allow children under 17 to use your account.

Subscriptions can only be purchased by users 18+ or with explicit parental consent in jurisdictions where required.

4. Your account

To use most features, you'll need an account. You agree to:

• Provide accurate information when registering.
• Keep your password secure.
• Be responsible for all activity that happens under your account.
• Notify us at hello@osyren.app if you suspect unauthorized access.

4.1 Account deletion

You can delete your account at any time directly from within the app:

• In-app self-service: Settings → Profile → Delete Account. Confirm the action — your account and associated data will be permanently removed within 30 days.
• Alternative methods: contact us at hello@osyren.app or via Telegram (@OsyrenAI) and we will delete your account within 30 days.

Note: Deleting your account does not automatically cancel an active subscription. You must cancel subscriptions through your Apple ID Settings (iOS) or Google Play Account (Android) — see Section 6 below.

5. Acceptable use

You agree not to use Osyren to:

• Break any law or harm anyone, including yourself.
• Generate or distribute illegal, harmful, hateful, or sexually explicit content.
• Generate content involving minors in any sexual or harmful context.
• Impersonate another person or misrepresent your affiliation.
• Attempt to reverse-engineer, decompile, or extract the source code of the app.
• Overload, attack, or disrupt the service or its infrastructure.
• Use the service to build a competing AI product or train other AI models on outputs.
• Spam other users via shared chats or shared reminders.

We reserve the right to suspend or terminate accounts that violate these rules.

6. Subscriptions and pricing

6.1 Subscription plans

Osyren is a paid service. We offer two subscription tiers:

• Osyren Starter — €2.99 / month (or local equivalent). Includes 200 AI messages/month, 10 image generations/month, unlimited reminders & calendar, voice chat, photo intelligence, multi-language, all core features.
• Osyren Pro — €9.99 / month (or local equivalent). Includes unlimited AI messages, 100 image credits/month, identity-preserving postcards, multi-image composition, iterative image editing, text-to-image generation, priority support.

Both tiers are auto-renewable monthly subscriptions. Local pricing applies based on App Store and Google Play pricing tiers in your country.

6.2 Free trial

Both tiers include a 7-day free trial. During the trial:

• You have full access to your selected tier.
• The trial automatically converts to a paid subscription unless cancelled at least 24 hours before it ends.
• You can only redeem one free trial per Apple ID / Google account, ever.

6.3 Auto-renewal

• Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the period ends.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the standard subscription rate.
• Subscriptions continue to renew even if you uninstall the app — you must cancel through your account settings to stop renewal.

6.4 Cancellation

You can cancel your subscription at any time:

• iOS users: Settings → [Your Name] → Subscriptions → Osyren → Cancel Subscription.
• Android users: Google Play app → Account → Subscriptions → Osyren → Cancel.

After cancellation, you keep access to paid features until the end of your current billing period. No partial refunds for unused time after cancellation, except where required by law.

6.5 Refunds

• iOS users: Refund requests must be submitted to Apple via reportaproblem.apple.com. Apple's standard refund policy applies.
• Android users: Refund requests within 48 hours can be made through the Google Play store; afterwards through Google Play Help.
• EU consumers: You have a 14-day cooling-off period from the start of your subscription to request a full refund, regardless of platform. Contact us at hello@osyren.app.

6.6 Restoring purchases

If you reinstall the app or switch devices (within the same Apple ID or Google account), your subscription can be restored via the in-app "Restore Purchases" option.

6.7 Price changes

We may change subscription prices in the future. Existing subscribers will receive notice at least 30 days in advance via email or in-app notification. You can cancel before the price change takes effect to avoid the new rate.

6.8 Family Sharing

Osyren supports Apple Family Sharing on iOS. The primary subscriber can share access with up to 5 family members. Each family member gets their own personalized Osyren account but shares the subscription.

7. AI-generated content

Osyren uses artificial intelligence to generate text, images, and suggestions. Important things to know:

• AI can make mistakes. Responses may be inaccurate, biased, incomplete, or inappropriate. Don't rely on AI output for medical, legal, financial, or safety-critical decisions.
• You are responsible for AI outputs you act on. If Osyren suggests something, the choice to follow it is yours.
• You own your inputs. The messages, photos, and data you provide remain yours. By submitting them, you grant us a limited license to process them solely to provide the service.
• AI outputs are not guaranteed unique. Other users may receive similar responses to similar prompts.
• Image generation may produce unintended results. Always review AI-generated images before sharing externally.

7.1 Prohibited AI uses

We actively filter NSFW content and prohibit:

• Generating explicit, adult, or sexual content.
• Generating images of real people without their consent.
• Creating misleading deepfakes or impersonation content.
• Any content harmful to minors.
• Defamatory, harassing, or threatening content.
• Content that promotes violence, hate speech, or illegal activity.

Accounts that violate these policies may be suspended or terminated without refund.

8. Third-party services

Osyren relies on the following third-party providers to function. By using Osyren, you acknowledge that your inputs may be transmitted to these providers for processing in accordance with their privacy policies:

• OpenAI — chat responses, voice transcription (Whisper), photo analysis. Privacy policy. OpenAI does not train models on API data per their API terms.
• Replicate — AI image generation (Google Gemini "Nano Banana" model for identity-preserving image editing and generation). Privacy policy.
• Firebase (Google) — authentication, multi-user features, data sync. Privacy policy.
• Railway — backend infrastructure. Privacy policy.
• Apple App Store / Google Play — payment processing for subscriptions. Apple/Google handle all subscription billing, charges, and refunds directly.
• Affiliate partners (GetYourGuide, Yesim, and others) — only when you explicitly click an affiliate link to make a booking or purchase.

9. Intellectual property

The Osyren app, website, branding ("Osyren" name and logo), design, and code are owned by KDN Estate SRL. You may not copy, modify, redistribute, or sell them without permission.

You retain ownership of the content you create with Osyren — your messages, plans, reminders, photos, and personal data are yours. AI-generated content is licensed to you for personal or commercial use, subject to the prohibitions in Section 7.1.

10. Service availability and changes

We work hard to keep Osyren running, but we don't guarantee uninterrupted service. We may:

• Update, modify, or discontinue features at any time.
• Perform maintenance that temporarily affects availability.
• Change pricing, subject to Section 6.7 above.
• Add or remove third-party integrations.

11. Account termination

You may delete your account at any time per Section 4.1.

We may suspend or terminate your account if you violate these Terms or if your use harms other users or the service. In cases of severe violations (e.g. illegal content, harassment), termination may be immediate and without refund.

12. Disclaimers

Osyren is provided "as is" and "as available", without warranties of any kind, express or implied. To the maximum extent permitted by law, we do not warrant that:

• The service will be uninterrupted, error-free, or secure.
• AI responses will be accurate, complete, or fit for any particular purpose.
• Defects will be corrected within a specific timeframe.
• The service will meet your specific requirements.

13. Limitation of liability

To the maximum extent permitted by law, KDN Estate SRL and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service — including but not limited to loss of data, missed deadlines, business losses, or reliance on AI outputs.

Our total liability for any claim relating to Osyren shall not exceed the amount you paid us in the 12 months prior to the claim.

Nothing in these Terms limits your statutory rights as a consumer that cannot be waived under applicable law (including EU consumer protection law).

14. Governing law and jurisdiction

These Terms are governed by the laws of Romania and applicable EU regulations.

Any disputes arising from these Terms will be resolved in the competent courts of Constanța, Romania, unless mandatory consumer protection laws in your country require otherwise.

EU consumers may also use the EU Online Dispute Resolution platform.

15. Apple-specific terms

If you downloaded Osyren from the Apple App Store, the following additional terms apply:

• These Terms are between you and KDN Estate SRL — Apple is not a party.
• Apple has no obligation to provide maintenance or support for Osyren.
• If Osyren fails to conform to applicable warranty, you may notify Apple, and Apple will refund the purchase price; Apple has no further warranty obligations.
• Apple is a third-party beneficiary of these Terms and may enforce them against you.
• Your use of Osyren must comply with the Apple Media Services Terms and Conditions.

16. Changes to these terms

We may update these Terms from time to time. When we make significant changes, we'll notify you via the app, by email, or by a prominent notice on osyren.app. Continued use of Osyren after changes means you accept the updated Terms.
